Contemporary paneled pigskin over beveled boards, raised bands lettering piece and tiny early shelf label to spine, colored edges, brass clasps. Negligible light soiling, tiny chip to head of spine, minor scuff to fore-edge of front board. Title page printed in red and black, moderate toning and foxing to interior. A very good copy in a notably handsome binding. $2,000. * Stryk was an important German jurist because he was one of the first to combine Roman and local customary law. Originally published in Latin in 1684, with later editions in Latin and German, De Cautelis Contractuum is one of the first treatises on contract law not based entirely on Roman law. It has four parts. The first part describes contracts that should be entered into with care, such as those concerning church or civil property, or those that involve children, drunks, or the deaf, dumb, or blind. The second part discusses loans, deposits, pledges and securities, bail, buying and selling, renting and leasing, inheritance, business partnerships and proxies. The third part addresses guardianship, inheritance, insurance, exchange and marriage. The fourth part is concerned with issues involved in the discharge and termination of contracts, including debts and receipts. In our edition, the main text is preceded by a brief essay on legal interpretation by Heineccius, an important German jurist and scholar who taught at the University of Halle.
